Marbella Private® · Legal information

Privacy Policy

Last updated 10 October 2026

1. Who is responsible for your information?

David Matterson, operating the Marbella Private® website and brand, is responsible for personal data submitted through this website. You can contact us at enquiries@marbella-private.com.

2. What information do we collect?

Our Private Enquiries form collects your name, email address and, if provided, areas of property interest. We also process information that you choose to send us by email or during subsequent correspondence. Our website hosting and form provider may handle technical information such as IP address and request logs for security and service delivery.

3. Why do we use it?

We use the information to receive, assess and reply to your enquiry and, where you ask us to do so, discuss your property requirements. Our legal basis is taking steps at your request before a potential contract, and where appropriate our legitimate interest in managing correspondence and maintaining website security. Where an activity requires your consent, we will ask for it separately.

The enquiry form does not automatically subscribe you to a marketing list.

4. Who receives the information?

Formspree processes form submissions and forwards them to our designated email account. Google provides the email service, and Netlify hosts this website. Those providers may process relevant personal or technical information to supply their services. We do not sell personal data.

We will not routinely share your property enquiry with estate agents, developers, property owners or professional advisers without first establishing an appropriate lawful basis, including telling you where necessary.

5. International processing

Some service providers may process information outside the European Economic Area. Where applicable, such processing must rely on a valid transfer mechanism and appropriate safeguards, including adequacy decisions or standard contractual clauses as relevant.

6. How long do we retain it?

We keep correspondence only as long as reasonably needed to handle your enquiry, any resulting professional relationship, and applicable legal obligations. Unnecessary enquiries will be periodically reviewed and deleted. Any information retained for statutory recordkeeping will be held for the relevant legal period. We review stored enquiries regularly and delete those no longer needed.

7. Your rights

Depending on the circumstances, you may request access, correction, deletion, restriction, portability or object to processing. You may also withdraw consent where consent is our lawful basis. Contact enquiries@marbella-private.com. You may complain to the Spanish Data Protection Authority at www.aepd.es.

8. Cookies and technical services

This website does not use advertising or analytics cookies. However, hosting platforms and linked third-party services may process technical data when used. We will update this notice and implement consent controls if optional cookies or similar technologies are added.

9. Updates and contact

We may update this notice as the business registration, service providers or website functionality change. Privacy questions may be sent to enquiries@marbella-private.com.
